Our personal injury lawyers are approachable and sensitive to your circumstances, with the specialist knowledge and expertise to guide you through the process.

We understand that no amount of money can compensate for the loss of a loved one, especially in such tragic circumstances, but it may be that you were dependent on the deceased’s income or need further support moving forward. Our experienced team offers free, no-obligation consultations to help you understand all your options and to guide you through the process of making a claim.

Especially in cases of medical negligence, workplace accidents, and road traffic accidents, holding those responsible can also help raise important questions that need answering and implement new safety measures that could prevent the same thing from happening to someone else.

Frequently Asked Questions

What Is the Statutory Bereavement Award?

Along with claiming compensation from those responsible for the fatal injury, certain claimants are eligible for a government benefit payment called the Statutory Bereavement Award or Bereavement Damages. The Statutory Bereavement Award is a form of financial compensation that can be claimed for fatal medical negligence or personal injury under the Fatal Accidents Act 1976. The award can be claimed by a dependant of the deceased, including the spouse, civil partner, long-term cohabiting partner, or a parent if the deceased was a child under 18.

Currently, the statutory Bereavement Support Payments in England and Wales stand at £15,120. These payments replace Bereavement Allowance (previously Widow’s Pension), Bereavement Payments, and Widowed Parent’s Allowance. If the claim is successful, the defendant or their insurance company will pay the Statutory Bereavement Award. Our specialist personal injury lawyers will guide you through the claims process, ensuring you are fully aware of any compensation payments you may be entitled to.

How can you help me with my claim?

Due to the nature of fatal injuries, the legal process of claiming compensation can be very complex and requires a solicitor with specialist knowledge. We’ll deal with all aspects of your claim and guide you through all available options.

As part of our holistic approach to care, we can even introduce you and those close to you to support groups that can help you come to terms with the consequences of losing a loved one in a fatal accident. We also work on a no-win, no-fee basis to ensure we obtain the maximum possible award for your injury compensation.

Will I have to go to court?

We can never say a case won’t go to trial or final hearing, but it’s unlikely. It’s often better if your case doesn’t go to trial, as the issue of court proceedings and the amount of work that goes into preparing and arguing your case can considerably extend the time it takes to settle your claim. Whether it goes to trial or a final hearing depends on your case’s prospects and the stance that the defendant takes. At The Personal Injury People, our lawyers have the knowledge and expertise to represent you at all stages of the claims process, including if your case does go to trial.
