Employer Liability – Injury by Another Employee

The Claimant was dismantling a marquee following a social event with some colleagues when one of his co-workers accidentally relinquished hold of the pole he was holding causing the Marquee to collapse and the middle beam to hit the Claimant’s foot causing him to sustain complex fractures to the left foot.

The Claimant was absent from work because of his injuries and developed arthritis in the foot. He was unable to return to his role as a Marquee Erector.

We were instructed to pursue a claim for personal injury and financial losses by the Claimant. Initially liability was denied by the two Defendants involved in the dismantling of the Marquee but after court proceedings were issued the Claimant accepted an offer in the sum of £50,000.00
